Has Mayor McMullan admitted to the Affair?

St. Catharines Mayor Brian McMullan continues to toy with his penchant for intimidation and harassment, although this time there is a new twist. As reported previously Christopher J. Bittle of Lancaster, Brooks & Welch LLP served, on behalf of his client, a Notice of Action on July 9th 2014. Four articles were singled out from Mayorgate which were claimed to have hurt his client's feelings.

Christopher Bittle's chant begins with “Your articles wrongly state an allegation of an affair as truth and use that as a basis to malign Mr. McMullan's character. These allegations are untrue.” The background music should now be building to a crescendo of thunderous proportion, “You have alleged the following conduct on the part of Mr. McMullan that is false: a) He has been involved in a affair with Debbie Zimmerman.” A crash comes sounding from the bass drum, “The above noted allegations are false and are presented as fact without any evidence of support.”

A Plaintiff's Claim was served on me as publisher of Mayorgate on August 26th 2014. This claim should have been a mighty climax, instead it turns out to be a tiny piccolo squeaking in the background. All protest and denial of the affair with Debbie Zimmerman had been dropped. Describing the so called defamation from point 12 through to point 21, Brian McMullan no longer denies the affair nor brings it up in his rhetoric, which in itself brings forth a serious issue to be dealt with momentarily. In fact not one single word is made to deny the affair. At this point regardless of how biased one may be to the truth or fact a simple observation comes screaming forth. Since Mayor Brian McMullan has stopped denying the affair with Regional Councillor Debbie Zimmerman, in legal documents at that, then he has finally succumbed to the weight of truth and admitted that fact. What other reasonable interpretation is possible by any reasonable individual?

In publishing and writing the articles on Mayorgate that span such a variety of relevant topics to our society one thread remains constant. As a writer, and author of any piece remaining on topic from the beginning to end is crucial in order to hold on to credibility. True evidence or documentation may need to be introduced, but the thread can never be lost. Those who write fiction or fantasy may have the luxury to meander into divergent fields but not an author of fact. Christopher Bittle as a lawyer on behalf of a client is in a way a writer, an author relying on the foundation of law for a clear and concise treatment of truth. That being said the main thread of his client's allegation from the Notice of Action, which begins any action under the Rules of Civil Procedure, has been dropped. The consequences are very serious.

Dropping all denial of the affair from his Statement of Claim, Brian McMullan has apparently admitted to the affair. That in itself is somewhat bewildering though there is a great deal more to examine. Christopher Bittle as a lawyer joined Lancaster, Brooks & Welch in 2010. He claims to specialise in Civil Law and Defamation Law. It would be expected that he would be quite familiar with the Rules of Civil Procedure. On behalf of his client Brian McMullan he served the Notice of Action on July 9th 2014, and now served the Statement of Claim on August 26th 2014. The Law Society of Upper Canada provides help and guidance on their website for the public and separately for lawyers. For lawyers the headings range from 'About Your License', 'Professional Rules' and 'Become a Lawyer'. Separately there is a heading titled 'How to Commence a Civil Action'. It would seem that years of university and passing the Bar Exam is not sufficient, a how-to guide is still required.


Under the heading 'How to Commence a Civil Action' there is a “How-to Brief,” truly there is, I do not jest. Quoting the Law Society of Upper Canada official website it states, “This How-to Brief outlines the steps to take when commencing an action.” There are eight steps outlined and step 3 is titled “Analyze the Case.” Bullet 5 here states quite clearly, “Where time is of the essence, prepare and issue a notice of action (form 14C). Note that if a notice of action is used, the statement of claim in Form 14D must be filed within 30 days of the notice of action being issued.”

In case Christopher Bittle missed this how-to guide there is a website provided by Law Help Ontario. This guide is called “Starting a Proceeding in Superior Court.” In simplified form a chart is provided, on the left “Start the Claim using,” in the centre the heading “Action.” Now I quote again, “If you start your claim with a Notice of Action, you must file a Statement of Claim (Form 14D not Form 14A) with the court office within 30 days after the Notice of Action is issued.” Mind you before one is able to file with the court office any notice of action, statement of claim or statement of defence, that notice or statement must first be served on the defendant or plaintiff and proof of service provided to the court.

Small Claims Court is the lowest rung on the ladder for the justice system of courts. It is used to adjudicate minor disputes so as not to clog up the court system and so as to get faster results. Brian McMullan had decided to not follow his lady friend and only lower his claim to the Small Claims Court. Yet all the rules under the Libel and Slander Act apply and rules of service. At point 16 of the Statement of Claim he attempts to provide an explanation as to why he missed the time limitation period under the Libel and Slander Act for one article in particular. Equally he has to comply with time limitations relating to the service of his statement of claim.

These rules which the courts and various legislation expect all to abide by are set to bring a unified and fair system of justice. They are also designed to permit a timely resolution to grievances. One such rule is simply a requirement that as an action begins with a notice of action it then continues unchanged, renovations and add-ons are not accepted. Christopher Bittle of Lancaster, Brooks & Welch threw this gem into the Statement of Claim point 13 (h), “Such further and other items as counsel may advise.” He continued again with point 14, “Despite the lack of evidence to support the defendant's allegations, Davidoff refused to print a retraction.”

Evidence, what is evidence? Webster explains the word to mean “2. something that makes another thing evident, indication; sign, 3. something that tends to prove; ground for belief, 4. Law, something presented in a legal proceeding, as a statement of a witness, an object etc; which bears on or establishes a point in question.” Rather simple and clear to understand one would think, it is for that reason that my Statement of Defence which was served on Christopher Bittle at Lancaster, Brooks & Welch and his client Brian McMullan on September 15th 2014, was 629 pages deep of evidence.



It appears that Lancaster, Brooks & Welch LLP's budget on copying ink must be extremely limited, as many of the pages copied by Christopher Bittle in his Statement of Claim relating to my articles are so very faint, and barely readable. I have provided them loud and clear to ensure no error is made. Soon more evidence will be provided at the mandatory Settlement Conference, and it will be interesting to hear how the Lancaster, Brooks & Welch orchestra supports the piccolo solo act.

Christopher Bittle and his client Brian McMullan have slandered both me and my website, mayorgate.blogspot.com, twice. First in his Notice of Action, Bittle states, “The above noted allegations are false and are presented as fact without any evidence of support.” Then the Bittle and McMullan tag team claimed, “Despite the lack of evidence to support the defendant's allegations, Davidoff refuses to print a retraction.” Now comes the opportunity to put Brian McMullan under oath and prepare the list of questions (oh, most are prepared already) that will come from the 629 pages of evidence. It is time for Mayor Brian McMullan to answer under the threat of perjury and finally provide the truth. Brian McMullan ran from taking the oath in his attempted intimidation of Regional Councillor Andy Petrowski, he cannot escape this now.

Reading each of the quotes chosen by Christopher Bittle for his client Brian McMullan one point stands out over and over again. Each of the quotes are intentionally taken out of context, no sentence simply stands alone. An example is the very first one labelled as #5 from Mayorgate's article 'Brian McMullan's Fear of Mayorgate'. “How far will the machinations of Mayor Brian McMullan reach past common dignity and continue to be motivated by the fear of truth?”.

This particular quote in fact is the opening to the article and appropriate to use here and now. It reads in full: “How far will the machinations of Mayor Brian McMullan reach past common dignity and continue to be motivated by the fear of truth? The answer to such a question is not easy to settle on, as time and time again Brian McMullan has proven that something new is always on the horizon.”

Christopher Bittle did leave out this quote from paragraph 4 of the article, “Still Brian McMullan's fear of Mayorgate grows and if that is not to be considered truth then another explanation of these actions by McMullan is welcomed, by Brian McMullan himself!”.

Brian McMullan chose threat and intimidation so as to silence a voice that reaches for the truth and raises very uncomfortable questions. Each article that appears on Mayorgate searches for the truth, raising questions and comment from its readers. The Supreme Court of Canada made it clear in its decision after hearing the Grant v. Torstar appeal that the threat of litigation against journalists silences the free exchange of debate.

McMullan claims that he had been hurt by facts being discussed openly, yet he is an elected public official paid by public funds. He claims that his credit had been affected by articles on Mayorgate, yet he intentionally lost his home and had his utilities cut off on an income of $160,000 plus. As one listens to the words of City of St. Catharines' Merritton Ward Councillor Jennie Stevens, in her own voice, stating that the Mayor had fixed a fine, can it be possible to make a fair comment that it was wrong? Will the voice of Councillor Jennie Stevens on the answering machine raise comment? Regardless of whether an individual is aware of the Municipal Act or of law itself, will there be comment?

Reading the divorce papers filed by the wife of Mayor Brian McMullan where she raises adultery in legal court documents and names Regional Councillor Debbie Zimmerman as the partner in adultery, is it fair to raise questions of conflict of interest? After all both Brian McMullan and Debbie Zimmerman are sitting on council together, and the nature of adultery is based on daily dishonesty. Does a husband tell his wife that he is off to a hotel with another woman rather than really having a business trip and expect that his wife will be calm about the whole thing? No, the husband lies! Can those lies then find themselves creeping into all other areas of his life? Do the people who he and in this case she, represent have the right to question the situation?

Truth, facts and the right to question is the foundation of journalism. At the same time those who prefer to stay under the cover of darkness threaten and intimidate to ensure that nothing or as little as possible leaks out.

In a bold and strong decision the Supreme Court of Canada decided that the protection of free speech was an absolute necessity to protect. The Supreme Court decisions in the Grant v. Torstar and WIC Radio v. Simpson cases have set the benchmark for both protection and defence of journalistic expression and freedom of speech.

Paragraph 31 from the Grant v. Torstar decision states; “In addition to the privilege, statements of opinion, a category which includes any “deduction, inference, conclusion, criticism, judgement, remark or observation which is generally incapable of proof” (Ross v. New Brunswick Teachers' Assn., 2001 NBCA 62, 201 D.L.R. (4th) 75, at para. 56, cited in WIC Radio, at para. 26), may attract the defence of fair comment. As reformulated in WIC Radio, at para. 28, a defendant claiming fair comment must satisfy the following test: a) the comment must be on a matter of public interest; b) the comment must be based on fact; c) the comment, though it can include inferences of fact, must be recognisable as comment; d) the comment must satisfy the following objective test: could any person honestly express that opinion on the proved facts?; and e) even though the comment satisfies the objective test the defence can be defeated if the plaintiff proves that the defendant was actuated by express malice. WIC Radio expanded the fair comment defence by changing the traditional requirement that the opinion be one that a “fair-minded” person could honestly hold, to a requirement that it be one that “anyone could honestly have expressed” (para. 49-51), which allows for robust debate. As Binnie J. put it, “[w]e live in a free country where people have as much right to express outrageous and ridiculous opinions as moderate ones” (para. 4).”

In this action brought about by Mayor Brian McMullan and his lawyer Christopher Bittle the issues extend far beyond the points of fair comment, public interest or of fact. A greater and more alarming facet of our society has to be defended. To this point Brian McMullan has been served with some 629 pages as a statement of defence, it is only the outline which the defence is to be based on. A further set of documents will be served on Brian McMullan prior to the court imposed settlement conference. The actual defence will begin with the dozens of questions Mayor Brian McMullan will answer under oath on the stand.

Our democratic society thrives under the belief that we as Canadians have certain rights which are protected under law and legislation. Although the laws and legislation do exist their protection is far from automatic. The issues here go far beyond a journalist being threatened or the public's interest. Rather the battle line is drawn on a greater field, one that we as Canadians cannot believe, or simply will not believe is possible in Canada.

Censorship is generally a tool used to weaken and control a society, in a way forcing it into submission of its will. Self-imposed censorship is an abomination of corruption of society, and no Canadian will believe that it is possible anywhere in Canada. In this case THEY ARE WRONG!

Quoting again from Grant v. Torstar, paragraph 36, “In the last decade, this recognition has sometimes been extended to media defendants. For example, in Grenier v. Southam Inc., [1997] O.J. No. 2193 (QL), the Ontario Court of Appeal (in a brief endorsement) upheld a trial judge's finding that the defendant media corporation had a “social and moral duty” to publish the article in question. Other cases have adopted the view that qualified privilege is available to media defendants, provided that they can show a social or moral duty to publish the information and a corresponding public interest in receiving it: Leenen v. Canadian Broadcasting Corp. (2000), 48 O.R. (3d) 656 (S.C.J), at p. 695 aff'd (2001), 54 O.R. (3d) 612 (C.A.), and Young v. Toronto Star Newspapers Ltd. (2003), 66 O.R (3d) 170 (S.C.J.), aff'd (2005), 77 O.R. (3d) 680 (C.A).”

Media has an obligation to provide the information to the public. Self-imposed censorship by the media is corruption of our society and it cannot be permitted under any circumstances. We are no longer so naive as to expect a completely unbiased media, as businesses form alliances and in turn pay dues on favours received. Politics is a business which has the power to demand such alliances and therefore extends massive influence on the media. Yet extending influence is completely different in nature to complete censorship.

In St. Catharines, Ontario every word of the Charter of Rights and Freedoms has been sold and forced to conform to corruption of free speech and thought. As alluded to earlier this is the centre of the action before the courts here. Brian McMullan will take the stand under oath and answer all the questions as demanded. In addition to McMullan absolute proof will be provided before the court of a system of censorship put in place which must be torn down. It is an opportunity that will not be allowed to pass.

Our public officials are elected by the public and are accountable to the public on every issue which in any way may or may not affect the public. Secrecy is unacceptable and full accountability demanded. Free flowing comment, the open exchange of information and discussion of facts are cornerstones of our democratic society. The Supreme Court of Canada in its decision of WIC Radio Ltd v. Simpson in paragraph 75 states: “People who voluntarily take part in debates of matters of public interest must expect reaction from the public. Indeed, public response will often be one of the goals of self-expression. In the context of such debates (and the risk of mixing metaphors), public figures are expected to have a thick skin and not to be too quick to cry foul when the discussion becomes heated. This is not to say that harm to one's reputation is the necessary price of being a public figure. Rather, it means that what may harm a private individual's reputation may not damage that of a figure about whom is known and who may have had ample opportunity to express his or her own contrary views.”

Public life brings with it public attention and accountability. In this case the issues extend beyond a public official hiding behind a lawyer and intimidation. Here the media has become a willing partner in the most unacceptable alliance imaginable by providing a self-imposed blanket of censorship. It is time to walk the halls of our Canadian Justice System and open all the doors to expose this corruption of our society.

There is a need to protect reputation against wild and intrusive media, against baseless accusations or innuendo. At the same time the over zealous demand to protect reputation only becomes a cover for those who have something to hide and the threat of litigation only becomes harassment and intimidation.

I leave the close to our Supreme Court of Canada once again and the Grant v. Torstar Corporation decision paragraph 62, and wait for the opportunity to stand before the court to defend against this harassment, intimidation and threat by Mayor Brian McMullan.

The protection offered by a new defence based on conduct is meaningful for both the publisher and those who reputations are at stake. If the publisher fails to take appropriate steps having regard to all the circumstances, it will be liable. The press and others engaged in pubic communication on matters of public interest, like bloggers, must act carefully, having regard to the injury to reputation that a false statement can cause. A defence based on responsible conduct reflects the social concern that the media should be held accountable through the law of defamation. As Kirby P. stated in Ballina Shire Council v. Ringerland (1994), 33 N.S.W.L.R. 680 (C.A), at p. 700: “The law of defamation is one of the comparatively few checks upon [the media's] great power.” The requirement that the publisher of defamatory material act responsibly provides accountability and comports with the reasonable expectations of those whose conduct brings with them the sphere of public interest. People in public life are entitled to expect that the media and other reporters will act responsibly in protecting them from false accusations and innuendo. They are not, however, entitled to demand perfection and the inevitable silencing of critical comment that a standard of perfection would impose.”

The OMB, a farce or something more?

The Ontario Municipal Board (OMB) is an independent administrative board, operated as an adjudicative tribunal in the province of Ontario, Canada. Sounds impressive, very formal and somewhat reassuring until the facade is torn away and its true reality revealed for what it is.

As an independent administrative board it hears applications and appeals on municipal and planning disputes under the Planning Act, as well as issues related to other legislative acts such as the Expropriations Act, Municipal Act and the Ontario Heritage Act.

Originally the OMB found life in 1897 as the Ontario Railway and Municipal Board assuming its current name in 1932, making it one of the oldest tribunals in the province of Ontario. The OMB itself is governed by the Ontario Municipal Board Act and since 2012 has reported to the Ministry of the Attorney General.

Standing on its own the OMB has jurisdictional powers legislated by the Ontario Municipal Board Act to act as an adjudicative tribunal. Quoting from the OMB Act, “The Board has all the powers of a court of record and shall have an official seal which shall be judicially noticed,” makes one feel even more impressed at the authority of the OMB. Through the OMB Act it is granted exclusive jurisdiction over the domain in which it operates and (quoting the Act itself again), “has authority to hear and determine all questions of law or of fact.”

Members and appointees to the OMB are responsible for the adjudication of disputes between parties appearing before the Board pursuant to the governing Act. Certain skills and abilities are therefore required from appointees such as the ability to listen and communicate clearly and effectively, the ability to objectively and fairly assess cases involving difficult issues. Each member of the OMB must have an understanding of the justice system and the role of administrative tribunals in that system. For such impressive understanding and ability members are paid a pretty penny ranging between $102,264.60 through to $178,412.26 annually, plus perks.

One expects that at least there is an avenue where serious issues regarding municipalities and their hand-in-hand partnership with developers can be questioned without bias. The cost of making an appeal to the OMB is not small and it is done so with only one real motivation, the overall benefit of the community. Now is the time to put the brakes on all the fantasy, bring it to a screeching stop and look at the reality of the OMB and its true reason for existence.

After one controversial decision in Manotick, Ontario, the Minister for Municipal Affairs at the time Jim Watson, was quoted in the local press as stating, “has the OMB been perfect? No. Can it improve? Yes, I think it can and I am quite prepared to work with the attorney general to try and ensure that the OMB is more reflective of community values.” (Ontario Municipal Board, Wikipedia).

Controversy has followed the OMB and its decisions. After the explosion of facts surrounding the whole gas plant fiasco and the Ontario Liberal Party, the footprints of the OMB were equally scrutinised. Yet one alarming example of how the OMB cares for the law or a community and its values comes from a hearing and the final decision in St. Catharines, Ontario.

The application for amendments to planning and zoning in themselves are not extraordinary, an almost daily occurrence in Ontario. What was extraordinary were circumstances surrounding the applications. The applicant had breached the Planning Act and Zoning By-Laws for over five years. Owner and operator Sam Demita of Sun Collision on Merritt Street, St.Catharines had acted with contempt of the law and with full knowledge of the City government.

Mayor Brian McMullan was fully aware of the breaches of law by Sam Demita. Merritton Ward Councillor Jeff Burch stood before a council meeting on April 29th 2013 and intentionally lied to council to protect Sam Demita. Director of Planning and Development Services James Riddell was not only fully aware of Sam Demita's breach of legislation he had stated that fact in the Corporate Report dated April 3rd 2013 on page 11. No action had been taken against Sam Demita by the City for his continuous breach of legislated law for some five years or more.



The OMB sent M.C. Denhez to hear the appeal, OMB Case No: PL130730 and File No: PL130735. Mr. M.C. Denhez arrived with an air of arrogance equivalent to a judge. He had all the documents from both sides and therefore ample opportunity to review the details. To repeat the words quoted from the Ontario Municipal Board Act, “has authority to hear and determine all questions of law and of fact.” According to the requirements sought in all appointees to the board, members must have an understanding of the justice system. Mr. M.C. Denhez, a member of the Ontario Municipal Board hearing an official appeal, brought the house down with these words in the opening moments: 

“Um, you do understand that in the 107 year history of the Ontario Municipal Board, there have been countless instances where a proposal came forward that was as pure as the driven snow. We're supposed to look at it in terms of this thing, the Planning Act, and we have what Provincial Government in its infinite wisdom calls 'a policy led planning system'. So we are supposed to assess everything in terms of what those policies are. And sometimes even when the background to the whole thing has been absolutely pristine, it's been dumped as illogical, and we're still obliged to turn it down. Inversely, there have been many times in the 107 year history of this thing that the proposal that has come forward has a background that smells to high hell. And yet somehow in terms of the policies that we're guided by, they still stumbled into the correct solution. All of which to say, we have to be very careful in looking at the background of all of this because we supposed to look at it on a go forward basis, in terms of the policies for the future, does this still fit? So I just leave that with you, if we do wind up getting into a long discussion of history I am, I may be obliged to cut it off at some point. Because that's not what we're really supposed to be here about, we're really supposed to be here about does this fit policy framework that has been imposed by the provincial government.”



Who is M.C. Denhez of the OMB? According to a biography published for OMB members (Public Appointments Secretariat, Canada, Agency Members Biographies), “Marc Denhez, is a bilingual lawyer, mediator and author of eight books on planning related issues, including environment and heritage.” It further states that “He has advised on legal policy, governance and drafting on related topics, in ten provinces, over a dozen countries, and at UNESCO.” It finishes by listing some of the organisations who had bestowed awards upon M.C. Denhez, such as the Canadian Institute of Planners, the Canadian Home Builders Association, Environment Canada and the International Association of Business Communicators. For a relatively short bio crammed with such impressive accolades it was expected to see the eight books authored by M.C. Denhez listed by title.

A lawyer of over 30 years, author of books, adviser on legal policy and recipient of awards, displayed nothing more than arrogant disregard for the law with his words, his own words. In fact reading the biographies of other members of the OMB and noticing how many have had environmental studies listed as an attribute should leave a warm and cozy feeling of security, but then there is the coal plant fiasco and then there is St. Catharines. Fantasy was fun whilst it lasted.

The issues surrounding this property had been extensively examined in previous articles. It is enough to state that Sam Demita had been found in breach of Ontario Regulation #347 by burying asphalt and other hazardous waste material. Planning and zoning by-laws had been simply ignored as non-existent by Demita. So M.C. Denhez came to “stumble into the correct solution,” by refusing to deal with the past and deciding that facts and laws were irrelevant.

On November 29th 2013, the OMB issued a decision delivered by M.C. Denhez. Six pages long with 26 individual points the decision was to dismiss the appeal and allow the law to be 'fixed' for Sam Demita by the City of St. Catharines. Point 5 states: “Though the neighbour argued eloquently, his appeal is dismissed. The background and reasons are outlined below.” In the final analysis M.C. Denhez made it clear that as a representative of the OMB and under their policies no history was relevant. What the City had adopted as the Official Plan Amendment (via By-Law 2013-138) and the rezoning (By-Law 138-39) was approved by 'the Board'.





Now under the Official Plan designation and zoning of the northwest corner (abutting the railway tracks and Sun Collision), which the city named 'area B', it was authorised for car storage. The rest of the area was zoned as “Mixed Use” and removed from EPA (Environmental Protection Area) to Commercial-Residential. City's Official Plan designation for 'Mixed Use' excluded car storage and in this case only the northwest corner was rezoned for that purpose. Everything was fixed and the past was wiped clean. “The Board was satisfied that they met the requirements of the public interest. The Board was also satisfied that the OPA and rezoning met statutory requirements.”

A smile as big as that of the Cheshire Cat sat on the face of M.C. Denhez at the solution he reached. The City only snickered in a self-satisfied air of continued corruption. Now it is time to view the result. Since the law was 'fixed' for Sam Demita he in his arrogance has taken the new law and urinated with contempt at it. Dated photographs taken over several months show that car storage is in fact spread over the whole length of the property.

In accordance with the amendments approved by the city and given blessing by the OMB and M.C. Denhez only the northwest corner (the city called this area B) was authorised for car storage. Wrecked and damaged vehicles have been stored across the opposite side of the yard adjacent and parallel to the Merritt Street fence line. This is Area A according to the city map as shown on page 11 of 15 of the Corporate Report from Planning & Development Services dated April 3rd 2013, report #PDS-103-2013. James N. Riddell Director of Planning and Development Services approved the report submitted by Judy Pihach Manager of Planning Development Services.



After M.C. Denhez issued his report in November 2013 Sam Demita undertook some cleaning of the land. Massive amounts of debris was removed, a piece of machinery called a Wylie 300 which is used to grind large chunks of asphalt to create asphalt aggregate has since been removed. Large deposits of asphalt illegally stored on the property in contravention of Ontario Regulation #347 had now been ground down to aggregate form. Several large mountains of aggregate asphalt and the newly ground asphalt had been moved out of sight to the very end of the property and hidden from view by portable storage units. Illegally stored asphalt in breach of Ontario Regulation #347 which permits the storage of asphalt for only 120 days for constructions purposes, had been stored by Sam Demita for well over 18 months!

Huge amounts of illegally stored asphalt had been intentionally kept on the property by Sam Demita knowingly in breach of law. M.C. Denhez brags in his biography of writing books on issues including environment, and receiving awards from Environment Canada. At the hearing he said, “why would I need to know where the fill came from?” Also at the hearing he was provided with direct evidence of the illegally stored asphalt. Yet all of this had no bearing on M.C. Denhez. He did not care about “a background that smells to high hell,” he claimed to care only for the future. This is the future M.C. Denhez made possible.



The City of St. Catharines implemented a new Zoning Plan in late 2013, it was supposed to make zoning issues easy to understand and presumably comply with. On page 38 of the Zoning Plan, section 6 Commercial Zone, sub-section 3.2 it states, “Outdoor storage is not permitted in any Commercial Zone, except for Motor Vehicle Sales/Rental Service Centre.” Sam Demita operates and owns Sun Collision, this is rather plain and simple to understand as far as the nature of the business. It is not a collision / sales / repairs / rental / anything I want / anytime I want it. Nor does Sun Collision constitute mini portable storage units with a slogan, you store it, I store it and I don't ask or care. City of St. Catharines Zoning Plan section 6 sub-section 3.2 is plain and clear.

In the Corporate Report of April 2013 approved by James N. Riddell Director of Planning and Development Services it states on page 9 of 15, “Staff note that the existing use of the site for outdoor storage is not consistent with the proposed amendments. Staff will be pursuing enforcement of the Zoning By-law, once the proposed amendment takes place.” Now that the by-law has been fixed to suit Sam Demita and Sam Demita has proven once again his contempt for the law what is the Director of Planning and Development Services to say?



At the Board hearing Nicole Auty, City Solicitor for St. Catharines was present. M.C. Denhez had suggested that a discussion may be worthwhile between the parties. Issues of evidence and the fact that the city only claims that enforcement will be undertaken after the amendments pass were to be topics. The appellant said, “I have to say this, that rarely does the law matter because otherwise you wouldn't have said it.” City Solicitor Nicole Auty became all hurt and angry responding with, “I take objection to that, it matters quite a lot to me.”

Nicole Auty continued to say that, “...how we deal with compliance issues, if we're advised that there are compliance issues, we speak to the owner and we seek compliance and one way that we do that is to require an amendment to the Official Plan, and in this case the zoning by-law, to designate an area where this is permitted. And when that by-law is in place, that's where it has to take place. Uses of that other space need to be confined to that area, and if they're not and the City does take steps and would take steps accordingly to deal with it.”





Since the laws were 'fixed' for Sam Demita in late 2013, Demita had decided to ignore them. Wrecked vehicles had been parked on the opposite side of the yard, vehicles have covered the full length of the yard, asphalt aggregate moved to another position in the yard and storage containers still are placed on nearly a third of the yard. Councillor Jeff Burch lied in Council to cover up the facts, now a question begs answering by Councillor Jeff Burch. What are you willing to do for Sam Demita now?


The City through the Director for Planning and Development Services James Riddell, City Solicitor Nicole Auty, Mayor Brian McMullan and Councillor Jeff Burch, together with OMB Member M.C. Denhez had facilitated the conditions for the continuing breach of law. When will the law be enforced or has Sam Demita been given permission to do as he pleases at whatever cost? It is time James Riddell kept to his word as presented in the City's report. It is also time for Nicole Auty as City Solicitor to stop playing at being hurt and act true to her sworn oath.

Photographs again proved intentional breach of the laws that anyone else has to abide by. At the OMB hearing the issue of photographs was a key to evidence, at one point as Demita tried to make claims regarding the asphalt photographs were produced to prove the truth. Sam Demita said, “Do not step into my property and take photos from now on.” No photos had ever been taken from within the property grounds, all photos had been taken from outside the fence and that can be clearly seen. This was stated to Demita who responded “Don't,” and then again, “You won't either.” The threat was uttered in front of the City Solicitor Nicole Auty and others.



In this case a business operator breached the law and legislation for some five years. A City Councillor, Jeff Burch, lied to council to protect him. Mayor Brian McMullan as Head of Council facilitated that lie. The City then fixed new laws to suit this businessman, and a member of the OMB decided that all past breaches of law were irrelevant. Provincial policy is a 'go forward' policy regardless of the past. The OMB decision was to give blessing to the fixed new laws.

Now the businessman has proven even greater contempt for the law. He as openly and willingly breached the laws that had been fixed for him. What will M.C. Denhez say to this situation now? Both Jim Riddell, Director of Planning and Development Services and Nicole Auty, City Solicitor have been advised of the situation with photos provided, as has M.C. Denhez of the OMB.



A final analysis leaves one unanswered question. What is the real purpose of the OMB? Is it a farce or is it something else? The rhetoric of Member M.C. Denhez fades into oblivion in light of fact. Ministers and the Attorney General may agree that the OMB is not perfect and that improvement must be sought. Here in St. Catharines the OMB in its policy driven decision process facilitated lies and breach of law. Perfection is a utopian fantasy, accountability is not. To quote M.C. Denhez once more “...somehow in terms of the policies that we're guided by, they still stumbled into the correct solution.” Did they really?

Mayor Brian McMullan Opens Pandora's Box



'If at first you don't succeed try, try again', might be Brian McMullan's mantra, or he may prefer 'Who dares wins'. Better still maybe McMullan's choice will be 'Gotta be in it to win it'. I on the other hand offer Mayor Brian McMullan these wise words spoken by Mr. Krabs from SpongeBob Squarepants, “What doesn't kill ya... usually succeeds on the second attempt.

Back in September 2011, Mayor Brian McMullan issued a legal threat that he was going to have Christopher Bittle of Lancaster, Brooks and Welch shut Mayorgate down. I published more evidence against McMullan and he grabbed his tail and ran. The threat resulted in an article, Mayor McMullan Attempts Shutdown of Mayorgate, and nothing more.

On July 9th 2014 I was served a Notice of Action that was five pages long. This Notice of Action was served on behalf of Mayor Brian McMullan, once again by Christopher Bittle of Lancaster, Brooks and Welch. Only this time McMullan won't be permitted to run, this time Mayor Brian McMullan decided in his arrogance to open the mythical Pandora's Box.







Pandora of Greek mythology was the first woman on Earth, created by Hephaestus at the will of Zeus. All the gods, Athena, Aphrodite, Apollo and Hermes bestowed upon her gifts. On her wedding day she was given a gift of a beautiful jar with instructions never to open it under any circumstances. Well Pandora's curiosity got the better of her and as she opened the jar all evil contained therein escaped. Even though Pandora tried to seal the jar, it was too late.

Brian McMullan has opened Mayorgate's jar and now after almost four years the facts, all of them, will be brought to open court. McMullan will not be given a way out and the consequences will finally be sought in a court of law. McMullan's penchant for intimidation and threat has now fallen on the wrong individual. His cowardly threat of a mythical statutory declaration will now be facing a subpoena forcing McMullan to produce it and explain who he meant in his, “we now have a statutory declaration...”. Who is the “we” in the threat, though there is little doubt as to who that is.

Unlike Pandora who had Aphrodite bestow beauty upon her and Hermes endow speech, McMullan has no such luxuries. Instead it has been the demigods of power who have protected Brian McMullan. When the law was breached there was no one to enforce its equality, when truth was demanded to be brought to the populace, the heralds of news and facts decided to lie or simply remain silent, and when the legislated laws were mangled those elected by the populace only provided protection and a coin in the collection plate.

The Notice of Action singles out four specific articles published in Mayorgate, “Brian McMullan's Fear of Mayorgate,” 20th of June 2014, “Debbie Zimmerman Attacks Mayorgate,” 14th of June 2014, “Four Years Old, Four Years Young,” 31st of May 2014, and “Degradation of Public Office,” 19th of May 2014.

As a lawyer who claims to specialise in defamation Christopher Bittle would presumably have knowledge of the Libel and Slander Act R.S.O. 1990 and Section 5(1). In case his law library is not as impressive as Jordan Goldblatt's (Sack Goldblatt Mitchell LLP) in Toronto and uncle Google was down on the day I'll quote:

No action for libel in a newspaper or in a broadcast lies unless the plaintiff has, within six weeks after the alleged libel has come to the plaintiff's knowledge, given to the defendant notice in writing, specifying the matter complained of, which shall be served in the same manner as a statement of claim or by delivering it to a grown-up person as the chief office of the defendant.”

Basically what this states is that after six weeks or 42 days it's strike out. Bittle and McMullan's Notice of Action was served on July 9th, even though it is dated July 7th. Do the math on the article titled Degradation of Public Office posted May 19th 2014. Strike out at 51 days, so the Notice of Action is down to only three for now. Bittle may try to argue the point of “...within the six weeks after the alleged libel has come to the plaintiff's knowledge...”, and McMullan's knowledge. First of all take a look at Brian McMullan's pal Debbie Zimmerman's little attempt to shut down the truth and its date. Try to claim these two don't have chats about the odd thing or two. If that's not enough, take a look at Maggie Riopelle's tweets and the “history” bit. Oh and if that's not enough still, look at the threat Bittle as a lawyer sent in October 2010 and backed off on.

Although this one is a strike out and Bittle has problems with math and the legislation I will answer all the issues here that have been released from Pandora's Box. Before I proceed point by point the Notice of Action begins with these words, “We are the lawyers for Brian McMullan...” and the letterhead clearly identifies Lancaster, Brooks and Welch LLP. On page four of the Notice of Action it states, “The above noted allegations are false and are presented as fact without any evidence of support.” This statement implies that I have lied as publisher of Mayorgate and slanders both my reputation and that of Mayorgate. As Christopher Bittle had made a previous attempt to accuse, threaten, harass and intimidate me and my publication, Mayorgate, which he dropped at the instructions of his client, he has full knowledge of the slanderous nature of such a statement. As he states that it is “we are the lawyers” therefore Lancaster, Brooks and Welch LLP are equally aware of the slanderous statement. Bittle presumably can read and again presumably has read the complete articles as published on Mayorgate. He has seen the evidence published yet chose to lie in his statement.

Brian McMullan has decided to hold hands with his pal Zimmerman and call his wife a liar. Rumours of the affair have floated across the Niagara Region like a bad smell for years and now the lies begin to grow. Who can forget Bill Clinton and all his lies till finally he had no choice. The croc shed his tears. Here in the case of McMullan and Zimmerman it would be no different. To rehash all the issues surrounding the nature of an affair and the pair who are entangled in it would be boring. Deceit is part of a daily routine for those who wish to party outside of the legal formalities and agreements of marriage which they themselves entered into freely to start with.

Both McMullan and Zimmerman need to go before a judge and prove that Ruth McMullan lied and that they are really only friends. This has to be done in a court of law and before a judge. The rest is simply the proverbial fish wiggling on a line before it is fried and served up. Instead both of them accuse and deny, they try to threaten and intimidate with the help of those sitting in Regional Government as servants of the public. All of this support may be cute in a B grade movie but here in reality it is the stripping down of democracy and nothing more than pornography to the mind.

Even though my article Degradation of Public Office is past its due date for the McMullan and Bittle pair, I will not ignore it. The first quotation that McMullan lists is simple and clear. McMullan and Bittle single out this sentence, “St. Catharines Mayor Brian McMullan has been able to breach the Criminal Code, have a local newspaper lie to cover for him, abuse the court system and walk away unscathed.”

Here comes the dissection of the McMullan frog, and no, Zimmerman – 'his friend' – can't kiss it better nor turn him into a prince. As a mayor Brian McMullan has limited powers and authorities, although his ego and arrogance doesn't always seem to think so. He has no authority to 'fix' in any way, shape or form a lawful by-law fine. Yet he did exactly that and it is a breach of law that he committed. Later when the insanity of anonymous cowards and their comments became public in relation to Regional Councillor Andy Petrowski, one of those cowards went so far as to make a false police report. Making a false police report is a Criminal Code breach. A mild mannered reporter from The Standard by the name of Doug Herod interviewed Mayor Brian McMullan regarding this whole situation. McMullan admitted to knowing “some” of these people and that was published. That in itself shows complicity and also breach of the Criminal Code. In both cases, evidence in the form of a recorded voice of City Councillor Jennie Stevens and the quotes directly from reporter Herod were presented.

Marlene Bergsma, longtime reporter of The Standard chose to lie in print regarding the whole mess with the ticket fixing. The proof is simple, it is in print and cannot be denied by Marlene Bergsma. Did Bergsma lie about the facts for any other reason other than to benefit Brian McMullan? Did Bergsma lie in print to benefit herself? Not only did Bergsma lie but following her reporter Peter Downs repeated the lie in print. In the case of Marlene Bergsma she will have an opportunity under oath to explain why she lied. McMullan may not like the truth but that's too bad. McMullan has shown little respect for the law by these actions and regardless of his manic threats now all the facts can be brought out in a court of law.

Speaking of courts of law dear Brian McMullan decided that using the NRP alone was not enough. He had a court order issued against Regional Councillor Petrowski accusing him of insane acts. McMullan claimed to fear the cuddly bear simply because he has a volume gauge out of normal levels. It all resulted with cuddly bear Petrowski arriving in court with a spunky lawyer at hand, and he was not there for free. Out of the four individuals required to present themselves before the judge Andy Petrowski and his lawyer were there, McMullan's lawyer was there, but the tough Brian McMullan was a no show. He only supposedly gave instructions by phone to drop it and run. The court's time wasted with contempt and the accusations now apparent to be false. Yet not a word heard from the judge on the abuse clearly displayed by Brian McMullan, although his lawyer ensures to bring to the court's attention that he is the mayor. All of this is part of a court transcript but maybe the giant of the legal world and star from Lancaster, Brooks and Welch would still claim “...presented as fact without any evidence of support.” Facts are facts and the evidence undeniable.

After raising the article Degradation of Public Office, McMullan and legal eagle Bittle of Lancaster, Brooks and Welch bring forth mention of my anniversary article Four Years Old, Four Years Young. This one squeaks in under the time limitations of the rules for Libel and Slander, though little needs to be spoken of. Once again McMullan and his pal Debbie Zimmerman need to prove that Mrs. McMullan is a liar, and that the people of Niagara are stupid, then maybe I'll comment further. Otherwise it is becoming boring.

McMullan moves to the article titled Debbie Zimmerman Attacks Mayorgate. Here it is clear the article is about his female friend, which also should prove an embarrassment for legal eagle Christopher Bittle of the venerable law firm of Lancaster, Brooks and Welch. Again it's the 'he says, she says' routine, McMullan and girlpal Debbie Zimmerman accusing Mrs. McMullan of a lie. Mind you neither has proven their claims, nor have they used the PR sheet of The Standard. Still both demand that only their word counts. But it is the first quotation under this sub-heading that counts:

Rumours of the affair had circulated not only in St. Catharines but throughout the Niagara area for some four years. These divorce papers raise serious questions in relation to government and deceit. In addition to asking questions regarding the affair I reported that Mayor Brian McMullan had come to my place of work on May 11th 2014. Brian McMullan came to deliver a threat, he did so like a bully and coward. In turn I had challenged him openly to carry out his threat. He lay claim to some statutory declaration which in some way appears to bear relations to the Conservation Authority and my day off work. Like a coward Brian McMullan has remained silent. Either this so called statutory declaration is just a lie or Mayor McMullan is still looking for the unattainable, just like the lion from The Wizard of Oz.”

Now that he and legal star Bittle have raised the issue, McMullan under subpoena will provide that mystical statutory declaration. I will not let Brian McMullan nor his lawyer Christopher Bittle off the hook on this one. McMullan will provide his statutory declaration finally.

Now to the first listed article titled Brian McMullan's Fear of Mayorgate. This one is definitely within the time limitations and on a personal note I am so damned glad. The first quotation raised by Bittle is, “How far will the machinations of Mayor Brian McMullan reach past common dignity and continue to be motivated by the fear of truth?”. I stand by every word and under oath McMullan will answer this question and more!

Mayorgate is an extension of who I am and my love of my community and of the values that we as Canadians teach our children. Mayorgate is also a brick wall that stands against corruption and lies with hard evidence and newsworthy content. Local media has proven that lies and censorship are the key in their decisions on what the public have a right to know. Mayorgate has no deals made, no political alliances other than to the people of this land.

Brian McMullan, Debbie Zimmerman and others would like to silence Mayorgate, it will not happen! The article Brian McMullan's Fear of Mayorgate dealt with many issues from the past four plus years. Bittle singles out four quotes all dealing with a threat of Adam Arsenault, a mayoral candidate in the upcoming municipal elections for 2014. The threat by McMullan of Arsenault was an illegal act, as it also was a lie in the actual wording of it. Arsenault himself provided the information in writing via email, and then copies of tweets between Adam Arsenault and Maggie Riopelle were obtained. Maggie Riopelle is Mayor Brian McMullan's Executive Assistant and her words as copied cannot be denied. As far as McMullan's interest in Jeff Burch and the need to protect Jeff Burch from the truth that will be dealt with further in the next article. It is legally safe to say that Burch's own words will provide a definitive clue. Yet it is important to note again that the whole issue of the threat against Arsenault rested on one single action by Adam Arsenault. In a tweet Arsenault had placed a link to a Mayorgate article dealing with Jeff Burch and not anything to do with Brian McMullan. McMullan is not running for the mayor's chain in 2014.

This article, Brian McMullan's Fear of Mayorgate, dealt with many issues, and all of them whether standing alone or together foul the air of politics. The McMullan/Bittle tag team decided to allow me now the legal right to bring into court evidence that was never able to be brought out publicly except for through articles on Mayorgate. As far as bullying goes McMullan will answer under oath and explain his actions relating to Andy Petrowski, Adam Arsenault, the mythical statutory declaration and more. Bittle decided to provide a truly bonus gift with the ticket fixing and the telephone answering machine message left by Councillor Jennie Stevens. It would be a pleasure to question Councillor Jennie Stevens under oath, to bring down Jim Bradley and the venerable cleaning lady Marlene Bergsma. Truth hurts and McMullan has opened the doors finally by bringing everything out in public and in court.

Lancaster, Brooks and Welch's legal eagle finishes with not only helping to open Pandora's Box but to jump head first into the mess left behind by arrogance and fear that now claims its hurt. Mayorgate has grown, I don't need to brag about that, and my love of our community has not faltered even under threat and cowardly insult. McMullan will be part of the history of St. Catharines but it won't be in a fashion he may wish to brag about.

Brian McMullan has one choice now, provide the Statement of Claim and head into court! McMullan and his little legal eagle Christopher Bittle will under subpoena provide the statutory declaration, and I have the evidence to prove that it is perjury.

I have faced threat, I have had my home stolen from me illegally by the City. I will not stop fighting for the values of Canada and Canadians. I want Brian McMullan under oath in a court room, and it won't be in St. Catharines. I will bring Marlene Bergsma, Jennie Stevens, Maggie Riopelle, Adam Arsenault and Jim Bradley under oath to answer questions. I will have Mayor Brian McMullan under oath providing his statutory declaration.

It is time to end the corruption in Niagara and Mayorgate will not run for cover or hide!

At the end of this piece I have provided a list of evidence, proof and documentation that has been published with each article. Maybe Christopher Bittle of Lancaster, Brooks and Welch would like to repeat his lie!
